This paper will research the new phenomenon of global private governance of intellectual property on the Internet, set up by globalized businesses or non-governmental organizations dominated by businesses. Although these globalized entities are adaptive to borderless Internet communications and trade, multinational corporations’ domination in norm-setting and enforcement may damage the public interests and distort the balance necessary for intellectual property protection. On the other hand, the principles for Internet governance, developed by the United Nations World Summit on the Information Society (WSIS), provide a new direction for intellectual property governance. Confinement of global private governance to these principles will be important in ensuring a balanced future for intellectual property protection. |
