Judicial Reform in Taiwan in the Past Twenty Years: On the Road to Independence

本文回顧和檢討過去二十年來，台灣司法改革的過程與它的成果和侷限性。我們分別依照改革發起的時間順序來分別討論律師、法官和檢察官的改革。本文指出台灣過去的司法改革，有下列幾個特色：主要改革行動者是年輕的律師與來自司法體系最基層的法官與檢察官、政治人物幾乎不參與這一波司法獨立改革、這些司法體系不同分支的改革者之間很少對話、司法獨立改革已有相當重大的進展、以及司法的民主可問責性此議題幾乎沒有得到任何的關注。

In this paper, we review the historical processes of Taiwan' judicial reform since democratization and criticize its achievement and limit. We first describe lawyers', judges' and prosecutors' reforms. There are several characteristics in Taiwan's judicial reforms. The reform participants came from the bottom of the judiciary. Politicians rarely participated in the reform movements. The reform movements of different judicial branches did not have much dialogues and cooperation. Judicial independence has made great progresses. The issue of judiciary's democratic accountability was ignored.
