| 英文摘要 |
This article is based on 2023 draft amendment to the sexual crime provisions of the Japanese Penal Code as the object of review. The author first introduces the process of introducing the offense of sexual intercourse without consent in Japan’s current legal revision (II), and then discusses the offense of taking advantage of social status to have sexual intercourse and the offense of taking use of mistake for sexual intercourse. This article indicates possible problems concerning the interpretation of the new provisions. This revision of the law has attracted widespread attention from the Japanese criminal law society. Through the introduction of this article, readers should be able to fully grasp the key points and have a more in-depth understanding of the status of sexual offenses in Japan. |
