本文是關於日本現行的裁判員裁判制度下所作出的量刑判斷之現況與其中所衍生出的問題點進行整理介紹並提出個人的分析與檢討。在本文中，一開始先進行裁判員裁判制度的介紹，再介紹該制度的施行前後關於實務上的量刑變化，並且介紹現行的量刑實務上所採用的參考準則；接著針對該準則中的其中一個項目－－「應該要考慮實施刑罰量化的評議」在判決和判例的運用實況進行分析說明及問題檢討。 |

The article discusses the current situation of sentencing judgments made under the citizen judge system in Japan, as well as the issues that have arisen from it. The author provides an analysis and review of the system, along with personal insights. The article begins with an introduction to the citizen judge system and then discusses changes in sentencing practices before and after the system’s implementation. Additionally, the article explains the current reference criteria used in sentencing practices. The author then examines issues related to one of the items in the criteria, which is the ’’evaluation of whether the implementation of punishment quantification should be considered’’ in the application of judgments and precedents. |
