Identifying contentious issues during the preliminary procedures has become essential since the implementation of the Citizen Judge Act. Because citizen judges are not legal professionals and cannot participate in extended court sessions, short-term and condensed trials are generally adopted. To conduct such a trial, judges, prosecutors, and defense attorneys must determine the contentious issues during the preliminary procedures, specifically, the primary points of dispute between the parties and the corresponding evidence. Moreover, only when the parties’claims are clearly articulated and supported by a well-structured evidentiary framework can the contentious issues of the case be effectively highlighted. Clarifying these issues enables the defendant to prepare an adequate defense, thereby preventing surprise judgments. |
