The Care of Medical Malpractices and its Mediation in Taichung

中文摘要 從申訴、抱怨到爭議,最後變成醫療糾紛的歷程,其實是有跡可循的。如果在申訴、抱怨到爭議階段就有預警機制,啟動關懷小組關心、聆聽病人的內心的聲音,協助解決病人的需求,就可能不必擴大糾紛走到訴訟的結果。臺中市在地方法院、衛生局、醫師公會、醫事法學會等的合作下,架構了解決醫療糾紛的體系,讓爭議不管在哪一個階段都有對應的處理機制。無論關懷、和解、調解與仲裁都是可選擇的解決方案之一,而避免進入醫療訴訟程序是這些解決方案的共同目標。事實上,訴訟的結果往往不能完全解決爭議,對醫病雙方的心理創傷並不能達到同時撫平的效果。首開先河的關懷小組,配上衛生局與公會的調處,再加上法院的調解試辦計畫,架構了一個完整有效的網絡。最近幾年的數據證明前開架構之網絡是有效的爭議處理制度,表示該制度已走在正確的方向,希望臺中經驗可以供各界參考,並不吝指導改進,打造無懼醫糾的優質醫療環境。
英文摘要

From complaints, complaints to disputes, and finally into the course of medical disputes, in fact, there is something to follow. If the appeals, complaints to the controversial phase of the early warning mechanism, start care group concern, listen to the voice of the patient’s heart, to help solve the patient’s needs, may not have to go to disputes and even litigation results. In cooperation with local courts, health bureaus, doctors’ associations and medical law societies, Taichung City has established a system for resolving medical disputes so that disputes can be dealt with at any stage. Whether care, reconciliation, mediation or arbitration is one of the solutions, avoiding access to medical proceedings is a common goal. Because the litigation results often can not completely solve the dispute, the medical trauma of both sides can not achieve the same effect. The first set of precedent care group, coupled with the Health Bureau and the Association of Mediation, coupled with the court’s mediation pilot program, the structure of a complete and effective network. The data in recent years has proved to be an effective dispute resolution system, indicating that it is in the right direction. Hope Taichung experience for all walks of life reference, and not hesitate to guide the improvement, to create a quality medical treatment without fear of medical environment.
