The revised Criminal Procedure Law has , for the first time, prescribed China’s exclusionary rule. Theoretical studies and discussions on the problems of implementing the exclusionary rule during the past year are in urgent need. This article studies the important issues that appeared in the implementation of the exclusionary rule, including the scope of illegal evidence, the operating procedures of the exclusionary rule, and the burden and standard of proof in excluding illegally obtained evidence, and suggests some measures to promote the comprehensive understanding and implementation of the exclusionary rule in China. |
