How to handle the relationship between mediation and judgment has always been a significant problem puzzling both the theoretical and the practical field. Based on the retrieval and analysis of important research materials about the relationship between mediation and judgment from 1943 to 2013, this report classifies the new situation and new issues in the research area of the relationship between mediation and judgment, proposes the breakthrough direction of innovation and the improvement measures in the future. It’s deduced that abundant research findings the academic prosperity formed during this era, however, significant theoretical disputes also formed in this era and the problem about the “theory separates from the practice” still exists to some extent. The research about the relationship between mediation and judgment is a core subject of the Judicial System in Chinese Characteristic Socialism. It’s necessary to strengthen the theoretical research about this subject, improve the research management, further refine the positive and negative experience from the combination between mediation and judgment, explore the operating rule in new historical circumstance, break through the theoretical impediment from eight directions (ideal, nature, value, procedure, method, target, function, subject) and achieve the leap of the theoretical cognition on the relationship between mediation and trial. |
