Spoliation of evidence is used to restore the balance betewwn the parties that has been destroyed by the the act of spolistion. Understanding the legal basis of the spoliation inference means understanding it from a concerning the spoliation of evidence, combined with the systematic objective of the system of evidence spoliation. At the same time, from a stsging view, a view from a diversified sanctions perspective should be taken in order to understand the application, and condition of spoliation. The application condition of the spoliation inference includes: the general constitutive conditions of the spoliation act and the special conditions for the application of spoliation inference. |
