The change to rights in rem of personal properties occurs frequently in social life. It can even be said that everyone participates in such change every day, and therefore its importance is not to be underestimated. This article will analyze and study the following aspects: the legislative principle of the change to rights in rem of personal properties resulting from juridical acts, the elements of juridical acts of rights in rem of personal properties, and the legal relation of double sale and double transfer. It will focus on topics including the will theory, formalism, the expression of intent with regards to rights in rem, delivery, the right to dispose, the fulfillment of suspenseful conditions (focusing on sale with retention of title), double sale and double transfer. By doing so, this article will explain the legal relation of the change to rights in rem of personal properties. |
