中文摘要 | 自大法官釋字第709號解釋,宣告舊都新條例部分條文部分違憲後,直至2018年底立法院完成新都更條例的修訂,新法已於2019年1月30日公布施行。本文撰寫之際適值新都更條例公布施行,乃先就眾所注目之新法有關都更之正當程序之部分與司法院釋字第709號要求之符合性作一檢視。其次,再就都更之行政正當程序的內涵,藉由最新之行政法院判決案例,分析實務見解之趨勢,最後藉由理論與實務裁判之分析,提出建構完整都更之層級化正當行政程序之步驟與具體標準,俾細緻化、完整化都更之正當行政程序。 |
英文摘要 | Since the interpretation of the Chief Justice Interpretation No. 709, itwas declared that part of the provisions of the Urban Renewal Ordinancewas unconstitutional, and until the end of 2018, the Legislative Yuancompleted the revision of the Regulations. The new law was promulgatedon January 30, 2019. At the time of writing this article, the appropriatevalue of the new regulations will be promulgated and implemented. First,a comparison will be made between the part of the new law relating to thedue process and the requirement of the interpretation of No. 709. Secondly,the content of the administrative due process is further improved. Thelatest administrative court judgment cases are used to analyze the practicalopinions. Finally, through the analysis of the theory and practice referee,the steps of constructing a complete hierarchical and proper administrativeprocedure are proposed. The direction, the meticulousness andcompleteness are all more legitimate administrative procedures. |
