中文摘要 | 基於法律行為(如合同等)的不動產物權變動,中國大陸法律原則上採債權形式主義的規範模式,即意思主義與登記相結合,方生不動產物權變動的法律效果。妨礙不動產權屬發生變動的因由,或存在合同效力問題,主要體現為當事人之間的意思表示瑕疵,或存在法定公示形式問題,即未辦理權屬登記。故中國大陸實務上對不動產確權案件的處理,係從法律行為效力的認定與登記與否兩個方面進行考量,如此,以確定所有權歸誰所屬。 |
英文摘要 | Based on the legal action (such as contract, etc.) of transferring real estate right, Mainland China, in principle ,adopts the creditor format, what combines intention and registration. On the basis of the legal theory, the reasons of transferring real estate right are validity of contract, which of the main problem is the flaws of declaration of intention, and the legal form of the public, which of the main problem is without going through registration procedures. As a consequence, in practice, it is necessary and feasible to consider the validity of contract and the registration. |
