司法院大法官釋字第748號解釋所稱之婚姻自由，指同性二人得為經營共同生活之目的，成立永久結合關係的實然描述，並未限定僅能以婚姻形式為之。慮及我國民法親屬編婚姻章之規定，存在社會通念上指稱男女生理性別意涵之男女、夫妻、父母等用語，底蘊臺灣人民之婚姻與家庭情感，具有維繫人倫秩序之重要意義。參以同性結合與異性婚姻在自然生育可能性、自然血親、生物學上親子關係等方面的本質差異，本文認為民法婚姻規定仍應維持在一男一女之結合，方為正辦。但可藉由增訂婚姻以外形式之「同性結合家屬」專節或專法規定，來補足我國同性二人成立永久結合關係之法律規範，俾滿足釋字第748號解釋之法制要求。 |
| 英文摘要 |
The purpose of this article is to analyze the optimal legal structure which allows two persons of the same sex to create a permanent union of intimate and exclusive nature for the purpose of living a common life in Taiwan law. This article is divided into three parts. Firstly, it explores the meaning of freedom of marriage under Taiwan Judicial Yuan Interpretation No.748 [Same-Sex Marriage Case]. Secondly, it argues that we should set up same-sex union relatives as a legal structure for two persons of the same sex in a permanent union of living a common life. Finally, it concludes by proposing draft legislation relative to Taiwanese same-sex union relatives. |
