為配合國家再生能源政策之方向，二○一三年十月九日修正發布之「申請農業用地作農業設施容許使用審查辦法」，增訂綠能設施之規定，鼓勵農民進行農業生產的同時亦發展再生能源。然而相關辦法實際施行的結果，卻是在全臺中南部造成「農地種電」的異象。對於此種農地農用與再生能源發展兩種政策下產生的衝突，本文嘗試從學理面先權衡兩種政策的價值順序，接著將相關規範所涉及的行政行為作一分析，並在兼顧兩種政策目的下提出可能的改善之道。

| 英文摘要 |
To honor government’s policy of renewable energy, the 2013 newly-amended “Regulation for Approval of Agriculture Facilities Usage” adds provisions relating to green energy facilities and encourages farmers to develop renewable energy while conducting agricultural activities. However, subsequent implementation of related guidelines has caused the issue of “farmland-generated electricity” in southern Taiwan. For the conflicts resulted from policies of “farmland used for farming” and “development of renewable energy”, this article attempts to balance the value priority from an academic perspective, analyzes relevant administrative actions and then proposes a possible solution while taking the two policy goals into consideration. |
