| 中文摘要 | 我國現行憲政體制中，總統之角色與職權，究為如何？因時間點之不同，總統可以是連虛位元首之權限均闕如的「宅男」，也有可能如學界所憂心的「超級大總統」。憲政體制中總統的職權與角色，實非常混淆不清而有深入檢討之必要。基於以上問題意識，本文首先就權力分立之觀點，檢討總統在我國政府組織中之定位。其次，經七次修憲後，現行政府體制趨近法國之「半總統制」。對此，文本亦將對法國何以採用此種制度，及其如何運作一併進行檢討。 |
| 英文摘要 | In Taiwanese constitutional system, the role and official authority of President is very confused and have the necessity to consider the issue. On the basis of the above awareness, firstly this paper was made to analyses the position of President in Taiwanese governmental system by the viewpoint of separation of powers.
Secondly, after 7 times constitutional amendments, the Taiwanese governmental system has come close to “semi-presidential system”. This paper also considers issues concerning with why French introduced this system and how to operate it. |
