中文摘要 | 本文旨在藉由「制度及其變遷理論」之援引,主張於判定都市計畫內保護區土地變更使用之准駁時,由於關涉各方利益,實有必要舉辦聽證,以化解爭議並提高共識度。又,為提升保護區土地變更使用之客觀性,本文亦建議主管機關應建構一套准駁評估指標之檢核機制。此外,經主管機關審核而未能獲准土地變更使用者,倘其使用受限已逾越「特別犧牲」之界限者,主管機關似應藉由「容積移轉」或相關機制,使其獲得合理補償,以符法制。 |
英文摘要 | This article quoted Institution Change Theory to reveal the necessary of holding a hearing, in the approval process of modification to Urban planning conservation zone, to resolve disputes and improve the degree of consensus among the interests of all parties.And to enhance the objectivity of modification to Urban planning conservation zone, the authorities should establish the examination mechanism of the evaluation index to do some examination in this case. Moreover, without approval of rezoning, the authorities should apply for the plot ratio transfer system or some related systems as due compensation, in the situation of the limitation of land use is beyond special sacrifice boundaries, so as to meet the law standard. |
