中國大陸期貨糾紛線上調解機制之反思與完善

期貨糾紛線上調解機制是中國大陸應對期貨糾紛持續上揚、保障金融市場穩定之重要舉措。透過檢視既有立法及實踐運行樣態發現，該機制存在法律之規定缺乏統一適用性、調解與訴訟之銜接機制不成熟、平台處理案件之功能偏弱等問題。透過梳理域外期貨糾紛調解機制可知，制定統一之調解規範、妥善處理調解與訴訟之對接機制、注重線上調解平台之功能發揮是制度良好運行之保障機理。統一期貨糾紛線上調解之法律適用、注重期貨糾紛線上調解與訴訟之銜接機制、提升期貨糾紛線上調解平台之運行功能是中國大陸期貨糾紛線上調解機制之制度完善要點。

The online mediation mechanism of futures disputes is an important measure for Chinese mainland to cope with the continuous rise of futures disputes and ensure the stability of the financial market. By examining the existing legislation and practice, it is found that the mechanism has problems such as the lack of uniform applicability of legal provisions, the immature connection mechanism between mediation and litigation, and the weak function of the platform to handle cases. By combing the mediation mechanism of foreign futures disputes, it can be seen that the guarantee mechanism for the good operation of the system is to formulate unified mediation norms, properly handle the docking mechanism of complaints and mediation, pay attention to the function of online mediation platform. Unifying the legal application of online mediation of futures disputes, paying attention to the connection mechanism of online mediation of futures disputes, improving the operation function of online mediation platform of futures disputes should be the key points of the system improvement of the online mediation mechanism for futures disputes in Chinese mainland.
