加重結果犯之結果關聯性──以傷害致死罪為中心

Criminal Offense with Aggravated Result–Focusing on Offense of Injury Resulting Death

本文討論加重結果犯之結果關聯性，提出的標準不僅要能區別加重結果犯與一般過失犯，也要能反映加重結果犯升高刑罰的理由。實務採取的一般過失關聯，無力提供加重結果犯與一般過失犯的區別特徵，而學說提出的諸如直接關聯性、致命性、風險同一性、高度加重結果風險等標準，雖有能力區別加重結果犯與一般過失犯，但無法反映加重結果犯升高刑罰的理由。至於輕率過失關聯，雖有說明升高刑罰理由上的優越性，但由於其與一般過失僅有量的區別，故在適用時產生定位上的困難。因此，本文以規範化故意理論重新理解加重結果犯之結果關聯性，主張唯有行為人對加重結果具有規範化故意，亦即理智公民在行為人的處境下均會認知到加重結果時，行為人始因其較高的主觀不法而構成加重結果犯。

This article uses the theory of normative intention to understand criminal offense with aggravated result, arguing that only the actor constitutes criminal offense with aggravated result, when he/she has normative intention for the aggravated result, that is, when a reasonable citizen will recognize the aggravated result in the actor’s situation.
