關於日本的性犯罪修正──以不同意性交、猥褻罪為中心（譯文）

On the Amendment of Japanese Penal Code－With a Focus on the Offense of Sexual Intercourse or Indecency without Consent

本文是以日本在2023年關於性犯罪規定的修法草案（現在已經完成修法而成為現行條文）作為對象加以檢討。作者首先介紹日本此次修法引進不同意性交、不同意猥褻罪的過程（貳），並再就引進的各種不同意性犯罪的類型中，不同意性交、猥褻罪中的利用地位進行性交的類型，以及欺罔錯誤類型，指出在適用上可能發生的疑問（參）。此次修法廣受日本刑事法學界矚目，透過本文的介紹，讀者應可充分掌握其中的重點所在，對於日本性犯罪的狀況應可有更為深入的認識。

This article is based on 2023 draft amendment to the sexual crime provisions of the Japanese Penal Code as the object of review. The author first introduces the process of introducing the offense of sexual intercourse without consent in Japan’s current legal revision (II), and then discusses the offense of taking advantage of social status to have sexual intercourse and the offense of taking use of mistake for sexual intercourse. This article indicates possible problems concerning the interpretation of the new provisions. This revision of the law has attracted widespread attention from the Japanese criminal law society. Through the introduction of this article, readers should be able to fully grasp the key points and have a more in-depth understanding of the status of sexual offenses in Japan.
