電氣警械管理法制之研究

警械使用條例雖歷經五次修正，但由於政治、經濟及社會上的變化日趨複雜，修改之幅度不及時代潮流的發展。又警察執勤的配備，亦未隨著科技的進步而佩帶科技警械，以致因執勤配備之不足而造成諸多憾事。
基此，為重新整建完備之電氣警械管理法制，本研究先就電氣警械管理所涉及憲法上之基本人權保障分析，再分別就外部管理規範及內部管理規範探討，同時對於警察人員使用電擊槍進行可行性分析。
本研究所探討之外部管理規範，包括：電氣警械之使用規範、電氣警械業者之管理規範，以及警察人員使用電氣警械後之國家責任；至於內部管理規範，則包括：建立內部控制規範（包含，員警使用警械報告表、裝備總務規範，及經費預算）、機關設置警械使用爭議事件調查小組。經綜合分析後，分別得出結論並提出法制建議，以建構完備之電氣警械管理法制。

Although Act Governing the Use of Police Weapon has been revised five times, as political, economic, and social changes have become more and more complicated, the magnitude of the revisions has not kept up as time goes by. In addition, the police’s weapon on duty has not been equipped with technological one along with the advancement of science and technology. As a result, the lack of weapon on duty has caused many regretting events.
Therefore, to reconstruct a complete legal system for the management of electrical police weapon, this article first analyzes the basic human rights guarantees involved in the management of electrical police weapon and then discusses external and internal management standards. At the same time, the feasibility analysis of the use of electric stun guns by police officers is carried out.
The external management standards discussed in this article include the use of electrical police weapon, the management of electrical police weapon manufacturers, and the state responsibilities of police personnel after the use of electrical police weapon. As for the internal management standards, they include establishing internal control standards (Including reports on the use of police weapon by the police, general weapon specifications, and budget), and the establishment of an investigation team for disputes over the use of police weapon. After a comprehensive analysis, conclusions are drawn, and legal recommendations were put forward to construct a complete legal system for electrical police weapon management.
