區塊鏈與算法的疊加應用──P2P網路著作權侵權糾紛預防機制構造

Applications of Combining Blockchain and Algorithms: Construction of a Mechanism for Preventing Copyright Infringement Disputes on P2P Networks

P2P技術的快速發展引發科技發展與網路著作權法律保護之間的價值平衡問題，技術發展的多變性與權利救濟的確定性之間存在的矛盾，使得現行法下P2P網路著作權人的法律救濟存在很大困境。以區塊鏈疊加算法作為新的技術方案與著作權法律保護之間存在內在契合性，可在技術模型建構的基礎上，透過聯盟鏈節點准入及權限分層設置、鏈內外數據交互機制、鏈內多節點共識分布式記帳、內嵌智慧合約自動化執行等功能，實現多主體間協調配合，形成清潔數據源，阻斷侵權作品上鏈傳播路徑，同時輔以文本相似度比對算法，輔助鏈內節點驗證機制，明確數據應用目的，提供數據處理和分析的方法。同時，上述機制落地還需要從權利、義務、責任以及經濟激勵等角度作合法性方案的進一步設計。

The rapid development of P2P technology raises the issue of value balance between technological development and legal protection of online copyright. The contradiction between the versatility of technological development and the certainty of rights remedy makes the legal remedy for P2P online copyright owners under the current law a great dilemma. The combination of blockchain and algorithm as a new technical solution is inherently compatible with the legal protection of copyright. Based on the construction of the technical model, it can realize coordination and cooperation among multiple entities through functions such as access and authority hierarchy setting of nodes in the alliance chain, data interaction mechanism inside and outside the chain, distributed bookkeeping by consensus of multiple nodes in the chain and automatic execution of embedded smart contracts, so as to form a clean data source and block the dissemination of infringing works on the chain. At the same time, it is supplemented by text similarity matching algorithms to assist the verification mechanism of the nodes in the chain, to clarify the purpose of data application and to provide methods for data processing and analysis. However, the implementation of the above mechanism requires further design of the legality scheme in terms of rights, obligations, responsibilities and economic incentives.
