The Reforms and Amendment Issues of the Right to Claim the Distribution of Matrimonial Property Under Taiwan Civil Code

本文之研究主題「我國剩餘財產分配請求權之爭議問題舆修法課題」於理論與實務上之見解有諸多分歧，擬研究之問題重點為：我國法定夫妻財產制剩餘財產分配請求權不斷修法之探討？進而產生公務人員退休資遣撫卹法增訂與剩餘財產分配請求權衝突？以及剖析法律漏洞、婚前財產、婚後財產、婚姻無效、婚姻撤銷、事實婚姻、婚姻存續期間貢獻等之相關問題點？進而提出批判法與比較法，故認有解釋論與立法論上之研究必要。

This article is entitled “reforms and amendment issues of the right to claim the distribution of matrimonial property under Taiwanese Civil Code” which discusses core issues including the exploration of the reform of the Art.1030-1 of Civil Code and the legal confusion over the right to the distribution of marital property between the Civil Code and Act Governing Retirement, Severance, and Bereavement Compensation for Civil Service. This article also explored the issues related to the legal loophole, the property acquired before marriage, the property acquired after marriage, void marriage, voidable marriage, de facto marriage, and the contribution during the marriage in Taiwanese marital property distribution regime. It is hoped that the research findings could be used to further law reforms from interpretative and legislative perspective.
