每一棟公寓大廈,都是《公寓大廈管理條例》服務的對象,用「服務」二字定義,乃是認同它為一部親民的法律,是建築物的安定力量,更是集居群眾的守護基礎;《公寓大廈管理條例》施行迄今近28年,歷經立法者多次研擬修法,對居住資源作出功不可沒效能,舉凡公寓大廈敦親睦鄰、修繕事項、公安消防、節能環保、組織運作等方面,架構更加扎實與健全的能量。在面臨爭議與訴訟上亦扮演穩定秩序角色,營造更和諧的居住環境。
惟與公寓大廈管理實務結合累積的論文研究並非普及,本文於碩博士論文加值網站以「公寓大廈管理條例」搜尋,2003年-2023年20年間,過濾作者具備法律科系、院所者,僅有4篇。本文從《公寓大廈管理條例》立法經過,到其核心的區分所有權人會召開與管理委員會組成,以管理委員會委員與管理事務人員角度視之,用較親民白話的法律語言,輔以相關判決與專書,建構立體多元的縱貫經緯,闡述《公寓大廈管理條例》的適用與運用,並納入集居地區如社會住宅、地上權住宅、集村興建農舍的探討,如遇條例不足之處,再行從民法、建築法、公司法等領域,尋求解釋。
主軸切進法律立場探討公寓大廈最高意思機關區分所有權人會議執行效能,與執行機關管理委員會的組成、運作與其當事人能力,輔以主管機關函釋與法院見解、文獻專書、社會輿論導入,尋求法秩序與區分所有的權衡,驗證《公寓大廈管理條例》適用與修法建議,期能將本文拙見提供公寓大廈管理委員會與物業從業人員,具備參考書籍性質使用。
英文摘要
Every apartment building is the object of service of the "Regulations on the Management of Apartment Buildings". The word "service" is used to define it as a law that is close to the people. Guard; the "Regulations on the Management of Apartment Buildings" has been implemented for more than 27 years. After many times of research and revision by legislators, it has contributed to the living resources. On the other hand, thestructure is more solid with sound energy. It also plays a role of stability and order in the face of disputes and lawsuits, creating a more harmonious living environment.
However, the paper research accumulated in combination with the management practice of apartment buildings is not popular. This article searched for "Apartment Building Management Regulations" on the value-added website for master’s and doctoral thesis. During the 20 years from 2003 to 2023, the authors were filtered out with legal departments and institutes. There are only 4 articles. This article starts from the legislative process of the "Regulations on the Management of Apartment Buildings" to its core divisions, the convening of the owners’ meeting and the formation of the management committee, from the perspective of the members of the management committee and the management affairs personnel, using the legal language that is more friendly to the people, supplemented by relevant judgments and A special book, constructing a three-dimensional and diverse vertical latitude and longitude, expounding the application and application of the "Regulations on the Management of Apartment Buildings", and incorporating them into the discussion of the construction of farmhouses in collective areas such as social housing, superficial housing, and villages. If there are deficiencies in the regulations, then The Bank seeks explanations from the fields of civil law, construction law, and company law.
The main axis cuts into the legal standpoint to discuss the executive effectiveness of the owner’s meeting, which is the highest authority of the apartment building, and the composition and operation of the management committee of the executive authority, as well as the ability of the parties. Order and distinguish all trade-offs, verify the application of the "Regulations on the Management of Apartment Buildings" and the proposals for amendments, and hope that this article can be provided to the apartment building management committee and property practitioners, and it can be used as a reference book.
