對消費者保護法制的回顧與展望──從兩則實務案例談商品和服務責任之若干法律問題

The Past and Future of Consumer Protection Legal System─Discussion on a Myriad of Legal Issues Regarding Goods and Services Liability through Two Practical Cases

於琳瑯滿目的商品和服務充斥在吾人日常生活的今日，因此而起的紛爭數量不僅相當可觀，且觸及之問題面向亦頗為多元。如何詮釋其中所涉之法律概念的內涵，對於與時俱進地彰顯出其現代意義，以及形塑消費者保護之發展方向，均具有深刻影響。有鑑於此，本文以觀察商品和服務責任之進程為基調，首先簡要回顧我國消費者保護法制的開展歷程，並從消保法和民法的相關規範來引介現行商品責任法所呈現之雙軌規範體系。緊接著，擬透過兩則實務案例來探討如：何謂提供服務之狀態、何謂商品或服務欠缺安全性、商品有欠缺等重要議題，冀能更清楚地描繪商品和服務責任之面貌，並略有助於合理地強化對消費者之保護。

In our daily lives filled with a wide variety of goods and services, not only is the number of disputes created thereby considerable, but the issues involved is also wide-ranging. How to interpret the legal concepts involved therein has profound impact on keeping up with the times to demonstrate a modern meaning, and shaping the direction of development of consumer protection.
In view of this, this article observes as a basis the progress of goods and services liability, and starts by reviewing our country’s development and history of consumer protection legal system, and introduces through the regulations of consumer protection law and civil law the dual regulatory system presented by the current product liability laws.
Then, through two practical cases, we discuss: what is a state of providing service, what is a lack of safety in goods and services, deficient products and other such important topics. This provides a clearer picture on goods and services liability, and assists in reasonably strengthening consumer protection.
