The rapid development of electronic payment systems has revitalized e-commerce and facilitated the efficiency of payment services in achieving the purpose of inclusive finance. In order to accelerate the development of e-commerce in Taiwan, on January 27, 2021 a large-scale amendment to the Act of Governing Electronic Payment Institutions was passed and the amendments came into effect on July 1, 2021. These amendments open a new page for Taiwan’s regulatory system of electronic payment institutions. This article focuses on empirical studies on the effectiveness of the EU First Payment Services Directives and analyzes the issue of whether the amendments to the EU Second Payment Service Directive can address the risks arising from the First Payment Services Directive while at the same time achieving the goal of accelerating the development of financial technology and financial markets. By analyzing and comparing the empirical studies between two EU directives, this article provides insights into any potential pitfalls or legislative approaches for Taiwan’s newly amended Act of Governing Electronic Payment Institutions in order to establish a complete regulatory system for electronic payment services while balancing personal data protection under said regulatory system. |
