The 111-Xian-Pan-8 Decision was the first judgment made by the Constitutional Court in adjudicating constitutional review cases after the implementation of the Constitutional Court Procedure Act. There are two main points of contention in this case: 1. The objective value order of basic rights is no longer a mere academic theory. The radiation effect of basic rights will affect the specific cases of courts at all levels in the future. Although this change is a concomitant effect of the judicial review system, at the same time, it is necessary to examine whether the basic rights determination of the reasons for this judgment is sufficient? 2. Although the reasons for this judgment have already explained why the petition in this case satisfies the requirements of the Constitutional Court for a substantive judgment, that is, the subject matter of review is necessary for the practice of fundamental rights or of constitutional importance.
