人民法院院長選任的政治邏輯──以“黨管政法”原則為視角

The Political Logic of the Selection of President of the People’s Court—From the Perspective of the Principle of“the Party’s Leadership over Political and Legal Work”

自改革開放以來，人民法院院長選任邏輯既是“黨管政法”原則在司法領域的具體實踐，也是中國共產黨“又紅又專”幹部政策的延續。在“黨管政法”原則主導下，人民法院院長的選任綜合了多重權威機構的交互影響、對政治“變量”的應對與整合以及“條塊關係”中的此消彼長，最終編織成複雜的權力關係網絡。在此過程中，人民法院院長群體并非純粹的政治官僚或技術官僚，其選任邏輯也不是“政治錦標賽體制”中簡單的線性晉升關係，而是從革命型精英轉型為司法治理型精英背景下的“政法幹部選拔模式”。

Since the reform and opening up, the selection of the president of the People’s Court has followed the principle of “party administration of politics and law” and the vivid manifestation of “virtuous politics”, which is also a continuation of the“red and special”cadre policy of the Communist Party of China. Under the leadership of the princi-ple of “party governance”, the choice of the president of the court combines the interaction of multiple authorities and political forces, the application of a series of power technologies and the response and integration of political “variables”, and finally weaved into a complex network of power relations in the election of the president of the court. In this process, the president group of the people’s court is not a pure political or technical bureaucrat, and its selection and appointment logic is not a simple linear promotion relationship in the “politi-cal tournament system”, but a“political and legal cadre selection mode” under the back-ground of transforming from revolutionary elite to judicial governance elite.
