德國監獄受刑人的勞動與社會復歸

The Work of the Prisoners and Their Re-socialization in Germany

本文主要以德國監獄中受刑人勞動之相關議題為論述與介紹。文中介紹德國監獄中受刑人勞動之法律規範與目的功能、受刑人勞動工作的型態、受刑人勞動之工資報酬、再社會化目標下受刑人勞動之爭論與再犯研究以及受刑人勞動作為社會復歸因素之實證研究成果。因文章篇幅之故，本文略就我國監獄行刑中受刑人勞動的相關問題進行些許的探討，在文章最後參考德國法制與經驗，為我國提出一些法制面與實踐面的建議。

This article primarily discusses and introduces issues related to the labor of prisoners in German prisons. Specifically, this article introduces the legal norms, purpose and function of the prisoners’ labor, the types of prisoners’ labor work, the wages of the prisoners’ labor, the research on the controversy and recidivism of the prisoners’ labor in light of resocialization as well as empirical research results of the prisoner’s labor as a factor of social re-integration. Because of the length of the article, the issue of prisoners’ labor in Taiwan will be discussed briefly and non-comparatively. Overall, the article provides some legal suggestions and practical advices concerning prisoners’ labor in Taiwan with references to German legal system and experiences.
