Reconstructing the Concept of Social Rights in Constitutional Law

本文提出在具備「基礎生存所需之維護」、「對權力分立無重大影響」、「無明顯財政資源重新配置需要」三個要件之下，司法應對人民根據基本權之積極給付請求有所回應。而面對人民所遭遇之權利實現障礙之型態，也可採行不同類型之司法作為以對應，其分別為「以防禦權形式實現積極給付請求權」、「以法律補充克服給付障礙」以及「提升行政機關之說理與舉證義務」。

This article proposes that with the three requirements of ’’ensuring essential minimum of subsistence’’, ’’no significant impact on principle of separation of powers’’ and ’’no obvious need for financial resource allocation’’ the judicial system should actively respond to the people’s fundamental rights. Judges can apply following three judicial Methods, wenn encountered with legislative inaction: ’’fulfilling the claim for active payment in the form of defense rights’’, ’’overcoming legal obstacles with methods of analogical Interpretation, teleological reduction or extension’’ and ’’raising the reasoning and proof duty of administration’’.
