近年來國際人權對刑事程序的重要性已日趨強烈。刑事程序中的人權保障應允了受害者及被告的救濟與正義。許多國際與內國的法院,包括台灣憲法法院,經常性地援引國際人權以提供程序性與實質性的正當程序給刑事被告。臺灣大學法律學院非常榮幸邀請到蘇黎世大學刑事訴訟法的Stefan Trechsel教授,同時也是現任前南斯拉夫特別法庭的指定法官,來探討這個重要的議題。Trechsel教授在歐洲人權法院所做案例的基礎上,探討了公平審判的權利,受逮捕者的權利與其它刑事程序相關的基本權利。其具有洞察力的討論讓我們對刑事程序中的相關國際人權有了新的理解。 |

The significance of international human rights for criminal procedure has become stronger in recent years. The guarantee of human rights in criminal procedure promises to both victims and defendants relief and justice. A great many of international and domestic courts, including the Taiwanese Constitutional Court, have often resorted to international human rights to provide procedural and substantive due process for criminal defendant. National Taiwan University College of Law is honored to have Professor Stefan Trechsel of Criminal Law and Procedure at the University of Zurich, who is also serving as Ad Litem Judge at the International Criminal Tribunal for the former Yugoslavia, to discuss this important issue. Based upon the case law of the European Court of Human Rights, Professor Trcshsel discusses the right to a fair trial, the rights of the accused, and a few other fundamental issues related to criminal procedure. His insightful discussion surely sheds a new light on our understanding of the relevance of international human rights to the criminal procedure. |
