In recent years, artificial intelligence (AI) has not only profoundly transformed human social life but also subtly reshaped the normative landscape of constitutional law. Empowered by AI, the surveillance practices of tech giants over users of social media and digital platforms have evolved into a new form of“panoptic prison”. At the same time, knowledge capable of manipulating human behavior—and even steering human thought—is being developed, whether intentionally or unintentionally. Confronted with this scenario that compresses fundamental rights and threatens to erode democratic structures, this article seeks to construct the state’s constitutional duty of protection in this context, to identify the conditions necessary for democratic legitimacy, and to offer concrete proposals for institutional reinforcement, in the hope of responding to the challenges and transformations brought about by AI. |
