In June 2023, Taiwan and the United States signed the first agreement under the United States-Taiwan Initiative on 21st-Century Trade, i.e. the Agreement between the American Institute in Taiwan and the Taipei Economic and Cultural Representative Office in the United States Regarding Trade between the United States of America and Taiwan. This agreement not only marked significant progress in the economic and trade relationship between Taiwan and the United States, the meaning and legal significance of the agreement also deserves particular attention. This article analyses the protection of foreign investment activities under the United States-Taiwan Initiative on 21st-Century Trade first agreement from the perspective of international law. Following the introduction, the second part of this article introduces the State practice of both Taiwan and the United States in the field of international investment law. The third part of this article then examines the relevant provisions in the first agreement to explore their legal significance in protecting foreign investment activities. The fourth part of this article further considers investment provisions in the free trade agreements concluded by the United States in recent years to demonstrate the importance of reaching a bilateral investment agreement between Taiwan and the United States for strengthening the protection and promotion of foreign investment activities between the two sides in the coming future.
