A Preliminary Inquiry into the Legal Framework for Siting High-Level Radioactive Waste Disposal Facilities in Germany: A Comparative Critique of the Siting Legislation for Radioactive Waste Disposal Facilities in Taiwan

本文聚焦於德國於二○一三年所公布，二○一七年修正之場址選擇法之立法思維與其所形構而成之整體場址選擇程序，以及德國學理對該法所為評析之說明。繼之，將以此為比較基礎，探究我國於二○○六年所公布施行之低放射性廢棄物最終處置設施場址設置條例在理論上與實際運作上所可能面臨之問題，以供相關單位修法或政策研擬與推行時之參考。

This treatise delves into the legislative rationale and the comprehensive procedure for site selection established by Germany’s Site Selection Act, promulgated in 2013 and revised in 2017, along with an exposition of the German scholarly critique of this statute. Subsequently, employing this as a comparative foundation, it investigates potential theoretical and practical challenges faced by the Act on Sites for Establishment of Low Level Radioactive Waste Final Disposal Facility inaugurated in 2006 in Taiwan. This examination is intended to furnish guidance for pertinent entities in the amendment of laws or the formulation and execution of policies.
