在越南，最高人民法院的司法委員會選定的裁判先例也被視為法律的補充來源，從司法當局的角度來看。它們被應用於解決沒有法律文件和其他來源規範並指導法律在裁決中的統一適用。此外，司法實踐的發展必須密切跟隨社會的快速變化，因此頒布的案例法可以反映在法律編纂過程中對特定法律問題思考的初步回應。本文將對與契約關係相關的判決先例進行分類和分析，從而展示當今越南在契約法思維上的發展。它主要集中於分析契約的形式和內容之間的關係，以及法院如何解釋和確定契約有效性的課題。

In Vietnam, the case precedents selected to be published by the Judicial Council of the Supreme People's Court are also considered as a supplementary source of law from the judicial authority's point of view. They are applied to solve cases without legal documents and other sources to regulate and guide the uniform application of the law in adjudication. Furthermore, the development of judicial practice must follow the rapidly changing society closely, so the promulgated case law can reflect the first steps of a change in thinking about a specific legal issue in the legal codification process. The paper will classify and analyze published case precedents related to contractual relations, thereby showing developments in legal thinking on contracts in Vietnam today. It mainly focuses on analyzing the relationship between the form and content of the contract, how the court interprets and determines the validity of the contract.
