In Vietnam, the case precedents selected to be published by the Judicial Council of the Supreme People's Court are also considered as a supplementary source of law from the judicial authority's point of view. They are applied to solve cases without legal documents and other sources to regulate and guide the uniform application of the law in adjudication. Furthermore, the development of judicial practice must follow the rapidly changing society closely, so the promulgated case law can reflect the first steps of a change in thinking about a specific legal issue in the legal codification process. The paper will classify and analyze published case precedents related to contractual relations, thereby showing developments in legal thinking on contracts in Vietnam today. It mainly focuses on analyzing the relationship between the form and content of the contract, how the court interprets and determines the validity of the contract. |
