探討代理孕母的醫療倫理

“Surrogate Parenthood”—a bioethical perspective

台灣於2019年成為亞洲第一個通過同性婚姻的國家，相較於婚姻平權上的完滿，生育平權顯示出許多待努力的空間，一直到2023年5月16日，立法院才三讀通過同婚專法修正案，開放同性配偶可比照異性配偶「共同」收養無血緣子女。除此之外，台灣目前現行《人工生殖法》的法規限制下，同性伴侶無法使用這項人工醫療技術，也尚未開放代孕。今年(2024年)5月，衛福部公告《人工生殖法》修正草案，相關議題又再度成為熱門討論焦點。

“Surrogate Mother”is no longer a bioethical issue today since the onset of this reproductive technology. Taiwan has legalized the same-sex marriage allowing the homosexual lovers to be legally married as couple in 2023. The demand and debate of giving these couple the right to have children has been controversial . If granting this right to the same sex couple, the reproductive regulations need to be modified. Do they have the right to have children through third-person donation of human eggs or sperms? If this right is given , how is it going to effect the traditional moral values and social order? This article will look at the issue from bioethical perspective.
