我國「原住民族健康法」之立法經緯與評析

The Legislative Process and Analysis of the “Indigenous Peoples Health Act” in Taiwan

為促進原住民族健康，建構以原住民族為主體之健康政策，改善原住民族健康不平等之國家憲法保護義務，我國在2023年5月26日經立法院完成三讀之「原住民族健康法」，成為保障原住民族健康之重要基石，然而，一切的法學，其本質上都是立法論；法學的宗旨，在於發現法律、歸納法律、推衍法律和闡釋法律。而法律的發現、歸納、推衍與闡釋，其實便是立法。本文乃就「原住民族健康法」之立法背景與推動過程進行觀察，並自立法院的立法過程，比較不同版本之差異，附帶決議的事項等，進行法律釋義並提出評析。

To promote the health of indigenous peoples communities and establish a health policy centered around them, and“Indigenous Peoples Health Act”through three readings in the legislative assembly on May 26, 2023. This act serves as a crucial cornerstone in safeguarding the health of indigenous peoples and aims to address the constitutional duty to rectify health disparities among them.
However, the essence of legal studies lies fundamentally in legislative discourse. The objective of legal studies is to discover, deduce, derive, and interpret laws. The process of discovering, deducing, deriving, and interpreting laws essentially constitutes legislation. This article observes the legislative background and promotion process of the“Indigenous Peoples Health Act,”comparing differences in various versions and providing legal interpretations and critiques.
