On Legal Engineering Paradigm

法律工程範式的核心要義在於，作為法律共同體的共同承諾，法律工程既是人們思考法律問題的現實背景與情境設定，又是人們認識法律問題以及與法律相關的社會問題的觀察視角與切入基點，又是人們理解法律問題的概念框架與理論模型，又是人們解決法律問題的方法論體系與思維路徑。法律工程範式既是法學學術研究領域法律共同體成員的基本範式，又是法律實踐領域法律共同體成員的基本範式。它不僅直接契合了法律的實踐本性與內在功能，而且直接標示了法律的工程屬性與實踐旨趣，因而其在當代中國的法學研究、法律實踐和法治發展中具有多方面的積極作用和價值。

As the commitment of legal communities, the core essence of legal engineering paradigm is that, it is the realistic background and the setting situation which the people think about, and the observation perspective and the base point of vision by which the people cognize the legal issues and the social problems related to laws, and it is the legal concept framework, the theoretical model, the methodology and the path of thinking by which the people understand and solve the legal problems and their relative social problems. Legal engineering paradigm is the basic paradigm of both legal scholars' communities and the legal practical experts' communities. It not only directly fits the practical nature of law and its intrinsic function, but also directly marks the quality of engineering and the practical purport of law. So, the legal engineering paradigm has many positive functions and values on the legal research, legal practice and the development of the rule of law in the contemporary China.
