論“一帶一路”倡議下數據安全共同體的規則建構

The Rule Construction of the Data Security Community under ''the Belt and Road'' Initiative

作為人類命運共同體思想的重要延伸，數據安全共同體理念具有五維內涵，應發揮其對“一帶一路”倡議下數據規則建構的理論指導功能。當前“一帶一路”倡議下的數據規則與數據安全共同體理念相比仍有差距，通過借鑒其他雙邊、區域性協定中的數據規則，結合“一帶一路”成員發展現狀，提出完善建議：國家維度下，增設政府採購數據“可追溯性”、存儲、保密條款，發展數據交換中的安全規則；人民維度下，設置總則性的個人數據保護條款，採納分類保護規則；主觀維度下，強化信任、信心、參與度、通知、救濟規則，提升人民數據安全感；工具維度下，建立個人生物、交通數據的附條件共享機制，積極利用數據促進區域安全；發展維度下，採納政府數據開放與數據包容性條款，並適當限制例外條款的適用。

As an important extension of the idea of a community with a shared future for mankind, the concept of a data security community has five dimensions, and should play its theoretical guiding role in the construction of data rules under ''the Belt and Road'' initiative. There is still a gap between the current data rules under the ''the Belt and Road'' initiative and the concept of the data security community. By drawing on the data rules in other bilateral and regional agreements, combining the concept of the data security community and the development status of ''the Belt and Road'' members, put forward suggestions for improvement: Under the national dimension, add ''traceability'', storage and confidentiality clauses for government procurement data, and develop security rules in data exchange; Under the people dimension, set general personal data protection clauses 'and adopt classified protection rules; Under the subjective dimension, strengthen trust, confidence, participation, notification and relief rules to enhance people's sense of data security; Under the tool dimension, establish a conditional sharing mechanism for personal biological and traffic data, and actively use data to promote regional security; Under the development dimension, adopt the government data openness and data inclusion clauses, and appropriately limit the application of exception clauses.
