The Multiple Treatment for the Criminal Custodial Protection of Offenders with Severe Mental Illness

監護處分為保安處分項目之的一，主要目的在於避免犯罪行為人再犯措施。也是監禁與保護精神疾病或其他心智缺陷犯罪者的特殊處遇，其主要目的在於社會復歸。尤其，2022年起法務部訂定受監護處分人社區轉銜機制指引，針對受監護處分者出院前3個月得邀集各相關單位，針對治療情形與需求等，共同研商辦理轉銜會議，建立社區聯繫平台。
為真實瞭解監護處分對復歸社會的影響與落實性，本研究透過立益抽樣，就南部地區承接監護處分之醫療院所中案例，抽取八位罹患有嚴重精神疾病案例判決書進行分析，藉由判決書所呈現的思維脈絡對監護處分者復歸社會的影響，並從社會復歸的觀點，理解在監護處分對於精神疾患者治療與復元的意義。
根據判決書分析與實證經驗顯示，建議可整體性發展量刑指引原則或藉由量刑委員會裁議程序作為裁判監護處分之依據，也認為監護處分的目的是社會復歸或是終身監護的思維值得討論。同時，因應法務部社區轉銜機制，應建立結案追蹤輔導機制，建立公私合作協力機制。據此，分別就流程面、資源面、組織面、人力面等議題提出建議供相關單位參考。

In order to truly understand the impact of guardianship on reintegration into society, this study uses purposeful sampling to analyze the verdicts of eight cases of severe mental illness from medical institutions that accept guardianship in the southern region, and to understand the context of thinking presented in the verdicts The impact on the reintegration of guardianship punishment to society, and understand the significance of guardianship punishment for the treatment and recovery of mental illness patients from the perspective of social regression.
