The report of the 20th National Congress of the Communist Party of China clearly stated that “accelerating the construction of Hainan Free Trade Port and implementing the strategy of upgrading the free trade pilot zone”. Establishing and improving a diversified mechanism for resolving civil and commercial disputes is an important guarantee for building an international first-class business environment and accelerating the construction of Hainan Free Trade Port. At present, in building a diversified mechanism for resolving civil and commercial disputes, Hainan Free Trade Port is facing problems such as a lack of international first-class arbitration and mediation institutions and specialized legislation, relatively lagging traditional judicial system reform, and the perfection of a legal guaranteed system. Therefore, Hainan Free Trade Port needs to actively learn from the beneficial experiences of countries and regions such as the United States, Singapore, and Hong Kong, China, and through various means such as improving relevant legislation, fully leveraging mediation roles, and deepening institutional reforms, to make civil and commercial dispute resolution more internationalized, market-oriented, legalized, convenient, and to establish a diversified civil and commercial dispute resolution mechanism that is in line with international standards and also has Chinese characteristics as soon as possible, comprehensively enhance the international influence and competitiveness of Hainan Free Trade Port in resolving civil and commercial disputes, and explore paths and accumulate experience for the modernization of China diversified civil and commercial dispute resolution mechanism. |
