全球化下的勞工權與貿易聯結：以美國雙邊FTA中的勞工標準作為檢視

Links of Labor Rights and Trade under Globalization: A Perspective of Labor Standards in Bilateral U.S. FTA

近年來各國在洽簽FTA時，基於政治、經濟、社會與文化情境上的差異，各國所認定或展現的勞工標準，也相當分歧且呈現多樣化，這使得各國本身的勞工法難以在國際的基礎上協調一致。以雙邊FTA的倡議者美國而言，本身也未完全批准國際勞工組織（ILO）公約中的勞工標準，僅「個案式」（case-by-case）地從北美自由貿易協定（NAFTA）起，建立「北美勞工合作協定」（NAALC）以作為勞工條款，而其後與約旦、智利、新加坡的FTA，在有關於條約的基本位置（basic location）、基本條款及制裁各方面，各有不同的談判標準。
因此，美國如何在各FTA的勞工標準間取得有效率的執行模式，成為未來與各國洽簽FTA的重要課題。首先，本文將說明全球化下自由貿易與核心勞工標準的關係與論述，其次，探討多邊層次的國際機制如國際勞工組織與世界貿易組織實施核心勞工標準的爭議，再次，探討美國推行核心勞工標準與貿易的結合，最末，以幾個美國自由貿易協定做為核心勞工標準的檢視，並分析核心勞工標準與貿易聯結的可行性。

Recently many countries facing a problem of non-compliance of labor standards when negotiating FTAs with other countries. On the situation of politic, economic, social and cultural diversities, it's difficult to make the domestic labor laws coincide with internationally recognized labor rights. The U.S. Free Trade Agreements set up standards of labor standards since the North American Agreement on Labor Cooperation (NAALC). But Can the labor provisions of NAALC or the following agreements as the model for future negotiating FTA? This essay will compare the differences in U.S. FTAs and explore the ways of effective enforcement in labor provisions of FTAs.
