行動通訊（2G）執照更新之探究

近年來，世界各國在通訊監管上，都面臨了如何在通訊技術瞬息萬變的通訊市場和在監管政策條件下取得平衡的地位。當然，目前最為嚴峻的挑戰不外乎是證照更新議題了。我國第二代行動通信（2G）執照有效期限即將在2011年屆滿，對於執照更新機制雖有待建立，但透過本文之分析架構應能有所借鏡。我國第二代行動通信執照更新程序，要掌握的最高原則是「通訊服務不可打烊、品質不能打折」而已。另外，也試擬我國2G執照更新之相關議題和作法，供有關人士參考。本文主要是蒐集和分析我國未來2G換發執照可能面臨的八項專題，探討行動通信執照更新的法規概要，更新程序，執照否准更換之理由，並且在執照更新程序中所牽涉到頻率的使用等議題。主要目的是使執照更新這個工作有最佳規範和實踐，並保證在更新後對相關利害關係人，會因此產生最佳的結果。有關執照更新最重要的原則是：（a）業務不中斷，品質不下降；（b）監管明確性和業者信心的確保；（c）掌握監管的彈性，使執照更新能和技術及市場發展相互配合，符合消費者的需求並且能兼顧頻率政策變動等。在執照否准更換或是在發照情況有所變動時，期間要如何過渡和安排，要有完善的措施和程序來完成它。而公開諮詢和行政訴訟權兩項措施，將是促使執照成功更換最大的保障。至於技術演進和數位匯流、技術中立以及實際經營環境等，是監管者不能須臾或忘的原則。最後，就現行技術標準之演進和基地站台架設的困難程度，作者大膽建議：允許2G執照延長並升級到LTE或是4G，將來3G及WiMAX屆期也允諾可升級到4G，則所耗費的社會成本將是最小，相對的消費者福利也會達到最高境界。

In recent years, global regulators are intensively efforts to get a balance status between the communication operator and the fast changing market, as well as the technological development and the policy condition. Certainly, these challenges also included the widespread application of regulation tools and the license renewal. All these will be discussed and analyzed in this paper. Our country's second generation（2G）mobile communication licenses are going to expire in 2011. In our country, we hold the supreme principle for the telecommunication service which is ''no closure service, no discount quality.'' As for the relevant renewal mechanisms are still pending and need to be established. Therefore, we hope the analysis framework of this paper could make contribution to the authorities. Moreover, we also draw up the related issues and a tentative plan on 2G license renewal in the Republic of China for the people who are concerned. Finally, according to current technology standard and erect the difficulty in base station, the author proposes boldly: Allow 2G license to lengthen and upgrade to LTE or 4G, 3G and WiMAX will be promised and can be upgraded to 4G at appointed date in the future, the social cost consumed will be minimum, relative consumer's welfare will reach the supreme realm too.
