The South Korean girl group BLACKPINK made a quick stop in Taiwan in March 2023 to hold a concert, which not only caused crowds to flock to the surrounding areas of the concert, but also triggered a phenomenon of rampant scalping tickets. Scalping tickets, according to the provisions of the “Social Order Maintenance Act” in Taiwan, refers to buying transportation or entertainment tickets with no intention to use and reselling them for profits. The sale of scalped tickets may affect other consumers’ purchase of tickets, and it may disturb the market price and order, which means ticket scalping could easily cause disputes and affect the rights and interests of consumers. It is necessary to regulate it by law. Coincidentally, in response to the chaos caused by ticket scalping, Mainland China promulgated the “Notice of the Ministry of Culture on Regulating the Operating Order of the Commercial Performance Ticket Market” and “Performance Ticket Service and Technical Specifications” in July 2017 and August 2021 respectively. Their purpose is to eliminate the complicated and opaque internal rules of the ticketing market, and eliminate the hoarding of scalped tickets, so as to return transparency to consumers, clean up the ticket purchase market, and ultimately achieve the maintenance of industry order and future development. The phenomenon of ticket scalping has a long history and is not limited to the performing arts market. It is necessary and useful to study how to use legal regulations to serve as a deterrence to scalping. Therefore, this article uses the method of literature analysis and comparison, so that through introductions to and comparisons of the relevant laws and regulations on the prevention of scalpers in Taiwan and Mainland China, it will be possible to find whether the enforcement of ticket scalping laws correspond to the original legislative intention of these laws, and whether they serve as an effective last line of defense to protect consumers in Taiwan and Mainland China from the chaos caused by scalpers. |
