In recent years, with the popularization of smart phones and the development of technological products such as driving recorders, the number of people reporting traffic violations has continued to increase, which has had a certain impact on the execution of police duties. Therefore, the Traffic Committee of the Legislative Yuan amended the Regulations on Road Traffic Management Penalties to limit the scope of reports to ease the burden on the police. However, whether the reduction of reporting items can effectively improve traffic order and enhance traffic safety still needs to be discussed. During the legislative process, the purpose of amending the law is mainly to limit malicious and continuous prosecutions, and to slow down the impact on police performance due to the large number of cases reported by the public. However, restricting whistleblowing items does not solve the root of the problem, because the focus is on how to avoid abuse of the whistleblowing system. The original intention of establishing the reporting system is to protect the public interest, not to use the people as a tool for reporting. Therefore, we should start from the system itself, strengthen the control of reporting, and avoid abuse. For traffic law enforcement agencies, the burden of dealing with a large number of traffic violation reporting cases is quite heavy. Restricting whistle-blowing items can ease their workload, but at the same time it may also limit the role of the whistle-blowing system. Therefore, it is more important to establish an effective case handling mechanism to improve handling efficiency and reduce the burden on the police. Restricting reporting items can temporarily ease the workload of the police, but it cannot solve the root of the problem. For the improvement of the reporting system, it should be aimed at improving its control and processing mechanism, so as to truly achieve the purpose of promoting traffic order and improving traffic safety. This article focuses on the people’s reporting of traffic violations and the law enforcement agency’s acceptance of people’s reporting of traffic violations as the research scope. It intends to discuss the impact of the traffic management law on the legislative process, the intent of the amendment, the traffic violation reporting system and the existing traffic law enforcement agencies. Is it beneficial to limit people's reporting of traffic violations? How to reduce the administrative workload of police agencies, improve traffic order and enhance traffic safety, and finally put forward conclusions and suggestions. |
