監督救濟編的調整範圍與框架構想－－強化整體型行政的法律監督與控制

The Adjustment Scope and Framework of the Supervision and Relief System: Also On Strengthening the Legal Supervision and Control of Holistic Administration

在行政法典編纂中，監督救濟制度是否需要納入行政法典、其調整範圍與監督救濟手段如何確定等，都是不能回避的基本問題。考慮到行政法體系的完整性要求，需要將監督救濟制度納入法典整體一併編纂，單獨設編，以避免出現監督救濟制度缺位及與其他部分銜接不足而導致的結構性缺陷。監督救濟編受制於行政法典的整體構造，也需要與公共行政活動編及行政組織編相呼應。為回應我國“大公共行政”的實踐需要，監督救濟編需要強化整體型行政的法律監督與控制，其調整範圍要覆蓋政府的所有職能，包括政府的發展職能和外部管理職能，監督救濟手段也需要在現有制度的基礎上進一步補充與完善，以實現對我國公共行政的全面監督與救濟。監督救濟編作為行政基本法典的重要組成部分，將提升行政基本法典面向國家治理未來需求的能力。

In the compilation of administrative code, whether the supervision and relief system needs to be incorporated into the administrative code, how to determine its scope and means are basic issues. Considering the integrity of the administrative law system, it is necessary to incorporate the supervision and relief system into the code, so as to avoid the structural defects. The supervision and relief system is subject to the structure of the administrative code, and also needs to correspond with the public administrative activities system and the administrative organization system. In response to the practical needs of 'great public administration' in China, the adjustment scope of the supervision and relief system should cover all the functions of the government, including the development function and external management function of the government. The means of supervision and relief also need to be further supplemented and improved on the basis of the existing system, so as to realize the comprehensive supervision and relief of China’s public administration. As an important part of the basic administrative code, the codification of supervision and relief will enhance the ability of the basic administrative code to meet the future needs of national governance.
