黨產條例對附隨組織之規範與實踐

The Norms and Practice of Affiliated Organizations in the Act Governing the Settlement of Ill-gotten Properties by Political Parties and Their Affiliated Organizations

黨產會依據黨產條例認定救國團為國民黨之附隨組織，並作成黨產處字第107005號處分，且於民國（下同）110年10月1日提出「社團法人中國青年救國團附表所列之財產是否為不當取得財產案」之調查報告，作為後續是否為不當取得財產之調查處理。
本件不當取得財產之調查及處理，涉及釋字第793號解釋之適用爭議，借此個案得進一步省思黨產條例對附隨組織之規範與實踐。

Based on the Act Governing the Settlement of Ill-gotten Properties by Political Parties and Their Affiliated Organizations (“this Act”), Ill-Gotten Party Assets Settlement Committee regarded China Youth Corps as the affiliated organization of Kuomintang and made a written disposition. This case is relevant to Judicial Interpretation No. 793 and could help us to understand and reflect the norms and practice of affiliated organizations in this Act.
