台灣代孕生殖立法推動與倫理探討

The Legislation Efforts and Ethical Considerations of Gestational Surrogacy in Taiwan

民眾晚婚與生育年齡延後，在現代社會十分普遍，使得不孕症比例上升，台灣估計約有15%夫妻患有不孕症，代孕生殖需求亦隨之增加，然而卻依然非法。本文介紹代孕生殖在我國推動立法之歷程、代孕生殖公民會議之結論、及人工生殖法修正草案之內容，按著探討代孕生殖所涉倫理議題、世界各國法規管理概況、歐美相關醫學會之建議指引，最後提出對臺灣代孕生殖立法應考慮方向之建議。

Delayed marriage and increased child-birthing age have made infertility a common problem which is estimated to be 15% in married couples in Taiwan. This also increased the need for gestational surrogacy which is still unlawful. This paper examines the history of legislation attempts, the conclusions of citizen’s councils, and the drafted law of gestational surrogacy in Taiwan. Relevant ethical issues, national legislations, regulations, professional guidelines on gestational surrogacy in some western countries are introduced. The authors then proposed their arguments on the legislation considerations in Taiwan.
