Delayed marriage and increased child-birthing age have made infertility a common problem which is estimated to be 15% in married couples in Taiwan. This also increased the need for gestational surrogacy which is still unlawful. This paper examines the history of legislation attempts, the conclusions of citizen’s councils, and the drafted law of gestational surrogacy in Taiwan. Relevant ethical issues, national legislations, regulations, professional guidelines on gestational surrogacy in some western countries are introduced. The authors then proposed their arguments on the legislation considerations in Taiwan. |
