以2008年12月發生於韓國安山市檀園區，趙斗淳對8歲小學女生以殘忍手段實施性暴力，並造成其終身殘疾的真實故事改編的韓國電影《素媛》（韓語：소원So-won），台灣譯為《希望：為愛而生》，韓國最高法院判決強姦及重傷害犯趙斗淳12年有期徒刑，該判決在社會上引起強烈反彈，公眾都指責該刑罰過於仁慈，最終導致韓國國會提高對兒童性侵犯的量刑標準，法院方面開始著手制定性犯罪案件審理改善方案，韓國法務部提出對兒童實施性暴力犯罪訴訟時效，應持續至該受害兒童成年時為止，並計劃修訂相關法律，以提升性暴力犯罪有期徒刑上限等應對措施，以及其他一連串修法防制作為。本研究即旨在運用文獻分析法、個案研究法及法學研究法，期盼能深入研究了解：一、韓國改編電影《素媛》實際融合的兩件犯罪案例及其原型。二、瞭解趙斗淳的犯罪前科及本案的案發經過。三、電影《素媛》改編後的案發經過概述。四、當年的爭議判決結果，以及電影上映後民眾的請願訴求。五、韓國基於本案的教訓，所進行的犯罪案件審理改善方案、修訂對兒童性犯罪量刑標準、訴訟時效，以及提升性暴力犯罪有期徒刑上限的各種對應措施。六、因應趙斗淳出獄後可能再犯或對受害者及其家人的威脅，韓國政府也擬定整體因應防制作為，然趙斗淳夫婦也對此提出惡質反制，人間惡魔重返塵世，悲劇尚未結束…。
