場域驗證之科研成果運用法制探析

The Study of Technology Development Program Results Utilization Legal System around Field Trial

場域驗證為協助科研成果商業化的重要手段，然而場域驗證一詞本身所涵蓋的範圍相當廣泛，隨著技術應用領域、技術或新創發展階段、驗證規模大小差異，而涵蓋模場試驗、概念驗證、商業驗證、試驗工廠等；而對於場域驗證所牽涉法制議題之討論亦較零碎，散見於探討監理沙盒、實驗場域或概念驗證補助政策等文獻中。因此本文以新興技術應用在驗證場域使用以及科研成果運用兩個面向，探討場域驗證所涉法制議題，並以英國在土地規劃與概念驗證等創新政策為比較，提出優化我國科研成果場域驗證機制，協助我國科研成果衍生新創跨越「死亡之谷」之法制建議。

"Field Trial is the key measure to the commercialization of Technology Development Program (TDP) Results. But it is difficult to have a unified definition for Field Trial because the definition varies according to the different of professional field, technological development stage, and scale. Such as pilot-scale test, proof of concept, proof of business, pilot plant. Similarly, there are many aspects to legal issues of Field Trial including emerging technology applications, land use control and R&D results utilization. By comparison with UK's innovation policy, this article suggests to construct a Field Trial mechanism with flexibility and co-creation."
