科研計畫研究資料開放運用機制的調整與修正

An analysis of Amending the Legal Institution for Sharing and Using the Research Data of Government Funded Research Projects

伴隨開放資料倡議與資料驅動型創新概念興起，政府科研計畫研究資料的共享流通逐漸受到各界重視。近年除了研究資料的管理與公開制度性措施，研究資料庫和研究資料開放共享平台的建置及相關機制，亦成為各國政策關注的焦點。觀察國際間近期推動的研究資料庫及基礎設施政策或規範，可發現其採取的資料公開治理措施，具備尊重專業治理並給予充分資源、以及研發單位得決定如何公開資料等特色。另一方面，國內目前於個別研究計畫或研發單位層級所擬定的研究資料管理基礎設施機制，亦分別顯示出各領域資料庫個別負責管理、賦予原研發計畫團隊決定如何公開之權限、提供管理所需成本費用等。基此，如欲作成國內整體性的研究資料庫與基礎設施政策，應得著重於研究資料公開機制類型化與層級化，同時透過中央統籌分配各單位與計畫的研究資料管理所需資源，並視整體研究資料管理與公開機制推動之進程，檢討規劃逐步導入資料庫權利，以兼顧制度調適與完備資料流通機制。（本著作為經濟部科技專案研發成果）

People have been paying more attention to related issues sharing the research data of government funded research projects in recent years. In policy, many countries focus on the system of research data repository and research data infrastructure. The policies are dedicated to three aspects. First, research funding agencies should respect professional governance of different kinds of research data repository. Second, the government should ensure and distribute enough resource for managing research data. Last, the policies make R & D institutions could decide how to share research data. In Taiwan, we also had similar measures in individual project or institution, like MED or SRDA. To comprehensively improve the policy of sharing and using research data, we would create more sharing practices for a variety of research data. Second, the government would plan to distributed resource for research data management in project or institution. Last, we would explore the database right how to help us increase the protection of research data right.
